Parties:

DaD refers to DaD Digital Pty Ltd ACN: 152 554 848

You refers to the Fertility Pinpoint account holder

Billings refers to WOOMB International Ltd and The Ovulation Method Research and Reference Centre of Australia Limited

DaD Digital has developed Fertility Pinpoint in conjunction with Billings.

1. Acceptance of Terms

a. By opening and using a Fertility Pinpoint account, you are agreeing to these terms of use.

b. DaD may modify these terms of use at any time and will notify you of such changes the next time you log into your account.

2. Description of Service

a. Fertility Pinpoint is an application for recording your signs of fertility using the Billings Ovulation Method™ and collaborating with your accredited teacher.

b. DaD provides the Fertility Pinpoint service entirely under the direction of Billings.

c. Fertility Pinpoint has no analytical functionality. It does not calculate when a woman is in her fertile or infertile stage of her cycle.

3. Privacy

a. The data recorded in your Fertility Pinpoint account is encrypted and can only be accessed in association with your identity using your password.

b. DaD will not, for any purpose, associate your username with your data without your consent.

c. The data recorded in your Fertility Pinpoint account is managed by DaD under the direction of Billings. The management, storage and use of your data is governed by the Billings privacy policy - for a copy of this policy, please see http://www.thebillingsovulationmethod.org.

4. Account security

a. You are responsible for maintaining the security of your account password. If you are concerned for the privacy of your password, you may change it at any time.

b. DaD is not liable for any damage or loss incurred as a result of the loss or theft of your password.

c. DaD takes all reasonable precautions to protect the security of your data. However, DaD is not liable for the loss or theft of your data through the malicious action of any third party.

5. Loss of data

a. DaD takes all reasonable precautions to safely store and preserve your data. However, DaD is not liable for any loss or corruption of your data.

6. Account termination, suspension and cancellation

a. DaD has the right to suspend or terminate your account without further warning if it reasonably believes you have breached any terms of use.

7. Intellectual Property Rights

a. You may not use any of the Billings trademarks without permission.

b. You may not copy, imitate or reverse engineer any of the Fertility Pinpoint software.

8. Proper use

a. You may not act in an inappropriate way in connection with your Fertility Pinpoint account, such actions including but not limited to:

i. Leaving offensive or derogatory comments on posts, blogs, or messaging services.

ii. Abusive phone or skype conversation.

iii. Attempts to gain access to any part of the application for which you are not authorised.

iv. Identity fraud.

b. You may not intentionally overload the server of the application.

9. Use and Storage

a. DaD retains the right to suspend an account which requires storage space in excess of a reasonable level.

b. DaD retains the right to cancel any account after it has been inactive for 40 years.

10. Communication with you

a. DaD may send correspondence to your nominated email address from time to time in relation to your account and the Fertility Pinpoint software.

11. No resale of the service

a. You are not allowed to resell access to this application.

12. Disclaimer

a. DaD disclaims any liability, and you agree to hold harmless DaD, Billings and all involved in providing the application, for any damage or loss incurred as a result of using the application or of the application failing to perform.

13. Indemnity

a. You agree to indemnify DaD against any damage or loss directly or indirectly caused by misuse by you of the Fertility Pinpoint application or any breach of these terms of use.

14. Choice of law and forum

a. This agreement is made under the jurisdiction of the State of Victoria, Australia.

15. General

a. This agreement has been prepared in English and will be controlling in all respects. Any versions appearing in other languages are purely for accommodation.
